利用規約
本利用規約（以下「本規約」）は、blueqat株式会社（以下「当社」）が提供する量子計算サービス「blueqat MCP」（mcp.blueqat.app）および「blueqat API」（qapi.blueqat.app）（以下あわせて「本サービス」）の利用条件を定めるものです。本サービスを利用することにより、利用者は本規約に同意したものとみなされます。
第1条（サービス内容）
本サービスは、量子回路シミュレータおよび実量子コンピュータへのアクセスを、MCP（Model Context Protocol）またはREST APIを通じて提供するものです。無料プランと有料プラン（月額980円）があり、プランごとに利用できる計算資源の上限（量子ビット数、ショット数、同時実行数等）が異なります。各プランの上限値はサービスページに掲載しますが、システム保護等のため予告なく変更されることがあります。
第2条（アカウント）
- 本サービスの利用には、当社の認証システム（auth.blueqat.app）でのアカウント登録が必要です。
- 利用者は、登録情報を正確に保ち、アクセストークン等の認証情報を自己の責任で管理するものとします。認証情報の第三者への共有・譲渡・貸与はできません。
- 認証情報の管理不備により生じた損害について、当社は責任を負いません。
第3条（料金・支払い）
- 有料プランの料金は月額980円とし、決済は当社が利用する決済代行サービス（Stripe）を通じて行われます。
- サブスクリプションは毎月自動更新されます。解約は決済ポータルからいつでも行うことができ、解約後は次回更新日以降の課金は発生しません。
- 期間途中で解約した場合でも、既に支払われた料金の日割り返金は行いません。
- 料金を改定する場合は、少なくとも30日前までにサービスページ等で告知します。
第4条（実機利用に関する特則）
- 実量子コンピュータは定められた稼働時間帯（稼働ウィンドウ）でのみ動作します。投入されたジョブは次の稼働ウィンドウまでキューで待機することがあります。
- 実機の稼働スケジュール、待ち時間、および計算結果の内容について、当社は保証しません。
- ハードウェア提供元の都合（メンテナンス、キャリブレーション、提供終了等）により、実機の利用が予告なく制限または停止されることがあります。
第5条（禁止事項）
利用者は、以下の行為を行ってはなりません。
- 法令または公序良俗に違反する行為、およびそのおそれのある行為
- 本サービスのサーバー・ネットワークに過度な負荷をかける行為、および利用上限の回避を試みる行為
- 不正アクセス、認証の回避、他の利用者のアカウントの使用
- 当社の書面による承諾なく、本サービスを第三者に再販売・再提供する行為
- 本サービスの運営を妨害する行為
第6条（サービスの変更・停止・終了）
当社は、メンテナンス、システム障害、その他運営上の理由により、本サービスの全部または一部を予告なく変更・停止・終了することがあります。当社は、本サービスについて稼働率その他のサービス水準（SLA）を保証しません。
第7条（免責）
- 当社は、本サービスにより得られる計算結果の正確性・完全性・有用性について保証しません。量子計算の結果は確率的であり、また実機の結果はノイズ等の影響を受けます。
- 当社は、本サービスの利用または利用不能により利用者に生じた損害について、当社に故意または重過失がある場合を除き、責任を負いません。当社が責任を負う場合でも、その賠償額は利用者が過去12か月間に当社に支払った利用料金の総額を上限とします。
第8条（データの取扱い）
利用者が本サービスに送信した回路データおよび計算結果に関する権利は利用者に帰属します。当社は、サービスの提供・維持・改善および不正利用の防止に必要な範囲で、これらのデータおよび利用状況（実行回数、リソース使用量等）を処理・記録します。
第9条（規約の変更）
当社は、必要に応じて本規約を変更することがあります。重要な変更を行う場合は、サービスページ等で事前に告知します。変更後に本サービスの利用を継続した場合、変更後の規約に同意したものとみなされます。
第10条（準拠法・管轄）
本規約は日本法に準拠し、本サービスに関して生じた紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。
Terms of Service
These Terms of Service ("Terms") govern the use of the quantum-computing services "blueqat MCP" (mcp.blueqat.app) and "blueqat API" (qapi.blueqat.app) (together, the "Service") provided by blueqat Inc. ("we", "us"). By using the Service, you agree to these Terms. This English text is provided for convenience; in case of any conflict, the Japanese version prevails.
1. The Service
The Service provides access to a quantum-circuit simulator and to real quantum hardware via MCP (Model Context Protocol) or a REST API. A free plan and a paid plan (JPY 980/month) are available, with different resource limits (qubit count, shots, concurrency, etc.) per plan. Current limits are published on the service pages and may change without notice, e.g. to protect the system.
2. Accounts
- Using the Service requires an account on our authentication system (auth.blueqat.app).
- You are responsible for keeping your registration information accurate and for safeguarding your access tokens and other credentials. Credentials may not be shared, transferred, or lent to third parties.
- We are not liable for damages arising from your failure to safeguard credentials.
3. Fees and Payment
- The paid plan costs JPY 980 per month, billed through our payment processor (Stripe).
- Subscriptions renew automatically each month. You may cancel at any time via the billing portal; no further charges accrue after the next renewal date.
- No pro-rated refunds are provided for mid-period cancellation.
- Price changes will be announced at least 30 days in advance on the service pages.
4. Real Quantum Hardware
- Real quantum hardware operates only during scheduled uptime windows. Submitted jobs may queue until the next window opens.
- We do not guarantee hardware availability schedules, queue times, or the content of computation results.
- Hardware access may be restricted or discontinued without notice for reasons attributable to the hardware provider (maintenance, calibration, end of service, etc.).
5. Prohibited Conduct
- Violating laws or public order, or conduct likely to do so
- Imposing excessive load on the Service or attempting to circumvent resource limits
- Unauthorized access, circumventing authentication, or using another user's account
- Reselling or re-providing the Service to third parties without our written consent
- Interfering with the operation of the Service
6. Changes, Suspension, Termination
We may change, suspend, or terminate all or part of the Service without notice for maintenance, system failure, or other operational reasons. No uptime or other service level (SLA) is guaranteed.
7. Disclaimer; Limitation of Liability
- We do not warrant the accuracy, completeness, or fitness of computation results. Quantum computation is probabilistic, and hardware results are subject to noise.
- Except in cases of our willful misconduct or gross negligence, we are not liable for damages arising from use of, or inability to use, the Service. Where we are liable, our aggregate liability is capped at the fees you paid us in the preceding 12 months.
8. Data
You retain all rights to circuit data you submit and to your computation results. We process and log such data and usage metrics (run counts, resource usage, etc.) to the extent necessary to provide, maintain, and improve the Service and to prevent abuse.
9. Changes to These Terms
We may update these Terms as needed. Material changes will be announced in advance on the service pages. Continued use of the Service after a change constitutes acceptance.
10. Governing Law and Venue
These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over disputes arising from the Service.
